A Secretaria de Avaliação, Planejamento, Energia e Loterias do Brasil publicou um rascunho de regras para apostas em resposta às próximas mudanças na regulamentação do jogo atualmente sendo considerada pelo Senado brasileiro. A capacidade financeira suficiente do negócio sports betting Brasil será determinada pela relação entre o capital registrado do operador e o volume de apostas que ele aceita. Os operadores que já operam no mercado brasileiro receberão uma “anistia” de seis meses para adequar suas atividades às novas regras. Um custo de licença na região de 4,2 milhões de euros pode parecer bastante oneroso para os operadores entrarem no mercado brasileiro, mas antes de concluirmos que é caro, sugerimos olhar as estimativas do mercado brasileiro. Estes valores na região de $1,4 bilhões – sob tais condições, o custo declarado da licença é razoável e deve ser pago por si mesmo.
Entretanto, é importante notar que a decisão de entrar no mercado brasileiro não depende apenas do custo da licença. A tributação também é um fator importante. Determinar o imposto com base na renda do operador é a principal idéia por trás da iniciativa legislativa agora em consideração. Anteriormente, o imposto era calculado sobre as taxas efetuadas. Esta abordagem de tributação é aplicada em vários países europeus (Suécia, Itália e Malta) e é mais eficiente e atraente para os operadores.
Além disso, a questão da suficiência da capacidade financeira do operador, que seria determinada pela relação de seu capital registrado com o volume de apostas aceitas, pode influenciar a decisão de entrar no mercado. Na França, por exemplo, foi implementada uma opção alternativa – foi definida uma quantidade clara de capital autorizado, que garante o cumprimento das obrigações para com os jogadores. Ainda não está claro em que proporção o capital autorizado do operador será determinado no Brasil em relação ao volume de participações aceitas.
A última coisa que eu gostaria de mencionar em termos de custos para os operadores estrangeiros entrarem no mercado brasileiro é a adaptação do produto. Para ter sucesso, os operadores estrangeiros terão que modificar seu produto para adequá-lo aos hábitos e preferências dos jogadores locais, que podem ser muito diferentes dos jogadores da Europa, por exemplo. Com base em nossa prática, os operadores que tentaram entrar no mercado sem adaptação do produto, mas simplesmente comprando tráfego, não obtiveram um resultado positivo.
Perspectivas para o mercado brasileiro
O mercado brasileiro está passando por mudanças radicais que visam a uma regulamentação cada vez mais clara das apostas. Está sendo feita uma tentativa de aplicar as práticas européias na regulamentação, o que, com um ajuste fino, poderia produzir resultados positivos – incluindo um aumento no volume de um mercado já grande. Para entender o tamanho do mercado: o Brasil tem cerca de 220 milhões de habitantes, e uma proporção muito grande da população (em comparação com outros países) não se importa em apostar. Como todas as iniciativas legislativas estão pendentes, estaremos observando todas as mudanças e observando o que eventualmente acontecerá com o mercado.
